US Judge Orders Andrew and Tristan Tate to Remain in Custody Amid UK Extradition Fight

Online influencers Andrew and Tristan Tate must remain in federal custody in the United States while they fight extradition to the United Kingdom, where they face charges of rape and human trafficking, a federal judge in Miami ruled Wednesday.

The written ruling by Magistrate Judge Lauren Louis followed an extensive bail hearing in which the brothers sought release from custody. The proceeding marked the Tates’ first public appearance after they spent weeks in separate cells at the Federal Detention Center in Miami following their arrest in July.

In her decision, Louis described the brothers as “quintessential flight risks,” finding that the evidence demonstrated an “exceptional capacity to flee the jurisdiction.”

Louis wrote that the brothers had “failed to meet their burden to demonstrate that they do not present a risk of flight or danger to the community, or that special circumstances warrant their release.”

The former kickboxers, who hold dual American and British citizenship, were arrested in Miami on provisional warrants requested by British authorities. The UK charges involve allegations of rape and human trafficking concerning seven victims. Andrew Tate faces 42 counts, while Tristan Tate faces 17 counts.

Additional charges against Andrew Tate include making or distributing indecent images of children and possessing extreme pornography. Both brothers have denied all allegations.

Reacting to the ruling, Joe McBride, the Tates’ defense attorney in the United States, expressed strong disagreement with the court’s decision to deny bail.

“We profoundly disagree with Judge Louis’ decision to keep Andrew and Tristan in federal custody,” McBride said in a statement. “Release would acquit them of nothing. It would simply allow them to prepare their defense.”

In a separate public statement, McBride added: “Detention first. Evidence later, maybe. Every burden in that courtroom falls on Andrew and Tristan. None of it falls on the government that wants Andrew and Tristan handed over. Two American citizens, on American soil, ordered to prove a negative against a case that does not yet exist on paper.”

McBride indicated that the defense team was considering whether to appeal the decision or proceed directly with challenging the extradition request.

“The Tates may just say, ‘You know what? We’re sick of the American system,’ and just may say, ‘Look, let’s just go fight it out in England,’” McBride noted.

During the bail hearing, both brothers took the stand and testified directly, appealing for their release so they could manage their legal defense across multiple jurisdictions.

“I want to fight the case against me and I can’t do it being here,” Tristan Tate told the court. “I can’t speak to my Romanian lawyer. I need to clear my name.”

In addition to the UK extradition request, the brothers face ongoing legal challenges in Romania. Romanian prosecutors have indicted Andrew Tate on suspicion of trafficking minors, money laundering, sex with a minor, and witness tampering, while Tristan Tate was indicted on allegations of complicity.

Prosecuting authorities pointed to years of digital media posts in which the brothers showcased significant financial assets and multiple passports as evidence of a potential flight risk. Defense counsel, however, argued that claims about their wealth were exaggerated online personas created to promote their digital businesses.

Matthew Jury, a legal representative for four British women pursuing civil claims against Andrew Tate over allegations of rape and assault, acknowledged the ruling.

“The Tates deny wrongdoing and are entitled to due process,” Jury stated. “The women whose allegations have waited years to be heard are entitled to it too.”

UK authorities have until September 16 to submit the formal extradition request to the U.S. Department of State. Once the request is submitted, an extradition hearing date will be scheduled.
