Justice Salim Ibrahim of the Federal High Court in Abuja has dismissed the N10 billion fundamental rights suit filed by actor Emeka Ike against Lere Olayinka, Senior Special Assistant to the Minister of the Federal Capital Territory (FCT), Nyesom Wike, and the Independent National Electoral Commission (INEC).
In a ruling delivered on Wednesday morning, Justice Ibrahim upheld the respondents’ preliminary objections, holding that the suit was incompetent and improperly constituted.
The judge also dismissed the substantive suit on the grounds of lack of proof.
Ike, who aspired to contest for the House of Representatives seat representing AMAC/Bwari Federal Constituency in Abuja in the 2027 general elections under the platform of the Nigerian Democratic Congress (NDC), lost the party’s primary election.
In May, Olayinka allegedly mocked the actor in a post on X by sharing his voter registration details on social media. Ike subsequently approached the court, alleging that the publication violated his fundamental right to privacy and the protection of his personal data.
In his court filings, Ike sought a declaration that Olayinka’s decision to publish his personal information on X without his consent amounted to a gross violation of his fundamental right to privacy and the protection of personal data.
The actor also asked the court to award him N10 billion in aggravated and general damages against Olayinka and INEC, jointly and severally, over the alleged violation of his rights.
In separate counter-affidavits, INEC and Olayinka urged the court to dismiss the suit in its entirety.
INEC argued that the information complained about by Ike was neither classified, sensitive nor confidential.
Olayinka, on his part, maintained that the information he shared on X was already in the public domain and had not been obtained through any unlawful means.
He further argued that he owed Ike no duty of care or confidentiality and did not require the actor’s consent to publish his name and passport photograph, which he claimed were already publicly available.
