A 33-year-old Oklahoma mother, Brennan Spencer, has been charged with second-degree murder after her infant son was found unresponsive at her feet following a night of alcohol consumption.
According to an arrest affidavit, Spencer went to bed intoxicated with her newborn twins after reportedly drinking several cans of White Claw hard seltzer with her partner, James Kelson. She later awoke with one baby in her arms — and the other lifeless at her feet.
The incident occurred in November 2024, but charges were not filed until July 2025, following a months-long investigation, People reports.
Kelson told investigators that he and Spencer had consumed a 12-pack of White Claw before he went to sleep. Spencer allegedly left the home around midnight to purchase additional alcohol, with surveillance footage showing her buying four tall cans at a nearby 7-Eleven.
By the next morning, Spencer had passed out on the couch with both babies. Her infant son, identified by initials RK, was found no longer breathing. His death was later ruled asphyxiation caused by an unsafe sleeping environment.
Authorities allege that Spencer’s high level of intoxication contributed to conditions that led to the child’s death. A child abuse examiner concluded the baby had been a victim of neglect.
Spencer is currently in custody, with bail set at $500,000. Her partner, who has not been charged, has described the case as a tragic accident and is reportedly seeking legal help via Facebook.
Spencer’s next court appearance is scheduled for August 5.
