DSS Affirms Legal Procedural Aspects of Emefiele’s Re-Arrest

The Spokesperson of the Department of State Services (DSS), Peter Afunanya, has characterized the re-arrest of the suspended Governor of the Central Bank of Nigeria (CBN), Godwin Emefiele, on July 25, 2023, following the granting of bail to the embattled apex bank chief by Justice Nicholas Oweibo of the Federal High Court in Lagos, as a “legally procedural” action.

Afunanya stated on Monday, that in contrast to allegations of wrongdoing directed at the DSS, the agency consistently adheres to court directives.

Furthermore, Afunanya revealed that the DSS had obtained a detention order from a Magistrate Court to maintain Emefiele in the custody of the organization.

Afunanya emphasized, “The Service had previously released a press statement addressing the altercation that transpired at the Court involving its personnel and those from the Nigerian Correctional Service (NCoS), and has committed to a thorough investigation.”

“While the investigation remains underway, initial findings have unveiled disconcerting aspects, particularly highlighting the regrettable conduct exhibited by certain public officials.”

The spokesperson for the DSS stated that Emefiele’s re-arrest was based on “substantial suspicion of committing a crime.”

“As is customary in criminal investigations, security agencies re-arrest individuals when there exists substantial suspicion of their involvement in a criminal act or as disclosed during an ongoing investigation. Emefiele’s re-arrest was conducted on this premise. While the re-arrest was influenced by the overenthusiasm of some personnel from the Service and NCoS, it adhered to legal protocols.”

Afunanya further explained, “Numerous reports have circulated regarding alleged instances of the DSS failing to comply with Court Orders, particularly in light of recent incidents at the High Courts in Lagos and Abuja.”

“In response to the events that transpired at the Court on July 27, 2023, presided by Justice (Edward) Okpe, the Service promptly submitted a request and obtained a detention order from a Magistrate Court. Consequently, Emefiele’s detention is legally authorized. In light of the ongoing legal proceedings surrounding the Emefiele case, the Service will refrain from providing additional commentary on the subject matter.”

“Whether focusing on Emefiele, Bawa, or Kanu, the Service has consistently adhered to judicial orders and followed proper procedural protocols in accordance with the rule of law. Constructive critics are encouraged to exercise greater discernment and enhance their research capabilities. Such an endeavor will unveil the Service’s commitment to obeying orders.

“The Court of Appeal’s judgment concerning Kanu warrants thorough examination. Perhaps, we can elucidate the nuances between ‘Discharged’ and ‘Acquitted,’ as well as comprehend the significance of each term within a Judge’s final decree.

“The DSS staunchly upholds the principles of the law. While some may contest this assertion, it remains factual. It is in this context that the DSS has pursued applications for either a stay or notice of appeal in certain cases. A disregard for the law would preclude any reliance on legal procedures, a stance the DSS has unequivocally embraced,” stated Afunanya.
