NBA Files Lawsuit Against Culture Minister Kenny Ogungbe for NYSC Certificate Issue

The Nigerian Bar Association (NBA) Section on Public Interest and Development Law has taken legal action by petitioning the Federal High Court in Abuja to remove Minister of Art, Culture and Creative Economy Hannatu Musawa from office. The petition alleges that Musawa violated the National Youth Service Corps (NYSC) Act.

The NBA is also urging the court to mandate the NYSC to invalidate the certificates issued to Musawa and music promoter Kenny Ogungbe, asserting that the issuance of these certificates contradicted the provisions of the NYSC Act Cap N84.

John Aikpokpo-Martins, Chairman of NBA-SPIDEL, and Funmi Adeogun, Secretary of NBA-SPIDEL, are the plaintiffs in the suit. They claim that the mobilization of Musawa and Ogungbe for the mandatory one-year national youth service after surpassing the age of 30 was unlawful, illegal, and a challenge to patriotism. The plaintiffs argue that the national service and certificates of service issued by the NYSC to Musawa and Ogungbe are null and void.

The plaintiffs seek a declaration that Musawa and Ogungbe are not entitled to employment by any employer of labor or services, including the Federal Government of Nigeria, without possessing and presenting their certificates of national youth service. Additionally, they aim for a declaration that Musawa is not entitled to hold the office of Honourable Minister of the Federal Republic of Nigeria or any public office in Nigeria after allegedly violating the provisions of Sections 2(1), 12(1), and 13(1) of the National Youth Service Corps Act, Cap. N84, LFN 2004.
