The DPP alleged that Ominnikoron, in collaboration with others who are currently evading capture, forcefully engaged in sexual intercourse with his 22-year-old passenger, Oluwabamise Ayanwola, a fashion designer, without her consent, leading to her subsequent murder.

According to Martins, the incident occurred on February 26, 2022, around 8 pm, between Lekki Ajah Conservation expressway and Carter Bridge.

Martins informed the court that the defendant and his accomplices, on February 26, 2022, unlawfully caused the death of Oluwabamise Ayanwole by throwing her out of a moving bus at Carter Bridge after sexually assaulting her without her consent.

He asserted that the charges are in violation of and punishable under sections 411, 223, 260, and 165 of the criminal law of Lagos State 2015.

The defendant entered a plea of not guilty.

During the court session on Tuesday, the prosecutor, Mohammed Olateju, stated that Omotubora, the defense counsel, has yet to provide a copy of the No Case Submission application to the prosecuting team.

In response, Omotubora explained that he is in the process of finalizing the application filing, stating, “We need a little time to meet filing. All that is left to be done is just scanning, which will be done as soon as possible.”

Following the exchange between the lawyers, Justice Sonaike adjourned the case to February 8, 2024, for the adoption of the application.
